Terms of Service

These Terms of Service ("Terms") govern your use of the A-Sim mobile application, website and related services (the "Service") operated by A-Sim ("we", "us", "our"). By creating an account or purchasing an eSIM, you agree to be bound by these Terms.

1. The Service

A-Sim sells digital SIM (eSIM) data plans for international travel. eSIMs are provisioned through our telecom partner network and connect you to local mobile carriers in your destination country. We do not provide voice calls or SMS — A-Sim is a data-only service.

2. Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase.
• Your device must be eSIM-compatible and carrier-unlocked. Locked phones cannot install third-party eSIMs.
• You are responsible for ensuring your phone supports the destination's network bands.

3. Purchases & pricing

• All prices are shown in Canadian Dollars (CAD) and include applicable taxes.
• Payment is taken via Stripe at checkout. Your eSIM is provisioned automatically once payment clears, typically within seconds.
• You will receive an install link by email with your QR code and activation details.

4. Plan validity & activation

• The validity window of an eSIM (e.g. 7 days, 30 days) starts when the eSIM first connects to a mobile network in the destination country, not when you install or buy it.
• You can install the eSIM days or weeks in advance with no impact on validity.
• Data allowances are consumed on a first-use basis and do not roll over.

5. Refunds

• Refundable: If an eSIM cannot be installed (incompatible device, technical failure on our end) or cannot be activated in the destination country (no carrier coverage), contact us within 30 days of purchase for a full refund.
• Non-refundable: Once an eSIM has connected to a network and consumed any portion of data, the plan is non-refundable.
• Refund requests: email support@a-sim.io with your order number and a description of the issue.

6. Top-ups

Active eSIMs can be topped up with additional data through the app. Top-ups apply to the existing profile and extend the validity according to the top-up plan purchased. Top-ups are subject to availability of the underlying package.

7. Network coverage & speed

A-Sim resells access to local carriers. Network availability, signal strength, speeds and supported technologies (LTE / 5G) depend on the local carrier's infrastructure and your physical location. We make reasonable efforts to publish accurate coverage information but do not guarantee a specific speed, latency, or uninterrupted service.

8. Prohibited use

You agree not to:

• Resell or commercially redistribute A-Sim eSIMs without our written permission.
• Use the Service for any unlawful purpose, including but not limited to fraud, harassment, malware distribution, or violation of local laws in your destination country.
• Tamper with, reverse-engineer or attempt to extract the cryptographic profile of any issued eSIM.
• Use bulk automation to scrape, probe or overload our systems.

We reserve the right to suspend or revoke eSIMs and accounts that violate these terms. Revoked plans may be non-refundable depending on the violation.

9. Intellectual property

The A-Sim brand, logo, app, website and software are owned by A-Sim. eSIM technology and underlying carrier services are property of their respective operators. You receive a personal, non-transferable, revocable license to use the Service for your own travel.

10. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will reach any particular destination.

11. Limitation of liability

To the maximum extent permitted by law, A-Sim's aggregate liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, special, punitive or exemplary damages, including lost profits, lost data, or business interruption, even if advised of the possibility.

12. Indemnification

You agree to indemnify and hold harmless A-Sim, its affiliates and personnel from any claim arising out of your use of the Service in violation of these Terms or applicable law.

13. Termination

You may delete your account at any time by emailing support@a-sim.io. We may suspend or terminate your account for breach of these Terms, fraudulent activity, or as required by law. Active eSIM plans purchased before termination will be honoured where technically possible.

14. Governing law & disputes

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-laws principles. Any dispute will be resolved in the courts of that jurisdiction, except where mandatory consumer protection laws of your home country provide otherwise.

15. Changes

We may update these Terms from time to time. Material changes will be announced in-app and emailed to active account holders. Continued use of the Service after a change constitutes acceptance of the updated Terms.
